TERMS AND CONDITIONS OF SALE

1. Purpose

These General Terms and Conditions of Sale (GTC) govern all services provided by blue invitation, including but not limited to sea excursions, whale watching, and related activities.
Any booking implies full and unconditional acceptance of these GTC.

2. Booking and Payment
​​​
A booking is considered confirmed and final upon receipt of full payment.

blue invitation reserves the right to refuse any booking in case of non-payment or incomplete information.

3. Weather, Technical Conditions and Safety
​​​
blue invitation reserves the right to cancel, modify, or shorten any activity for reasons including but not limited to:

-
adverse weather conditions
-
sea conditions
-
breakdown or technical constraints
-
captain’s decision for safety reasons
-
behavior of a passenger endangering the group
In such cases:
A rescheduling or partial/full refund may be offered.
No refund will be due if the activity is shortened for safety reasons.

4. Cancellation and Modification by the Client
​
All cancellations must be made in writing.

More than 30 days before: full refund
-
Less than 30 days before: 50% refund
-
Less than 72 hours before: no refund
-
No-show: no refund
​
No refund will be granted in case of:
-
weather conditions deemed acceptable by the captain
-
absence of animal sightings

5. Delay and Absence
​
Any delay by the client may result in refusal of boarding without refund.
For shared tours, blue invitation will wait 15 minutes after the scheduled meeting time.
After this delay, in order not to shorten the tour for other passengers, the activity will begin.
It is the client’s responsibility to allow sufficient time for arrival.

6. Nature of the Activity

The client acknowledges that:

wildlife observation is unpredictable
-
sea conditions may change rapidly
​
No guarantee of results can be given.

7. Liability
​
blue invitation is subject to an obligation of means, not of results.
Its liability cannot be engaged in case of:
-
loss, theft, or damage of personal belongings
-
injury resulting from failure to follow instructions
-
client negligence
-
unforeseen external events

8. Limitation of Liability
​
In all cases, the liability of blue invitation is limited to the amount paid by the client for the service.

9. Physical and Medical Fitness
​
The client declares being physically fit to participate in the activity.
It is the client’s responsibility to inform blue invitation of any medical condition.
blue invitation reserves the right to refuse participation to anyone presenting a risk to themselves or the group.

10. Conduct Onboard and in the Water
Any dangerous, disrespectful behavior or failure to follow safety instructions may result in immediate termination of the tour without refund.

11. Force Majeure / Exceptional Circumstances
​
In the event of circumstances beyond our control, including but not limited to:
war, riots, natural disasters, epidemics, pandemics, exceptional weather conditions, government decisions, border closures, administrative restrictions, or any situation preventing the activity,
blue invitation may:

cancel
-
postpone
-
modify the service

without liability.
No automatic refund may be claimed.
A credit, rescheduling, or partial refund may be offered.

12. Insurance
​
blue invitation is covered by professional liability insurance.
Clients are strongly advised to take out personal insurance covering cancellations and water-based activities.

13. Third-Party Commercial Activities
​
Any commercial activity, service, or paid activity carried out by a third party during excursions organized by blue invitation is strictly prohibited without prior written authorization.
This includes, but is not limited to:
-
external professional photographers or videographers
-
any professional service

Clients are not authorized to organize or allow external service providers for commercial purposes without prior approval from blue invitation.
In case of non-compliance, bue invitation reserves the right to refuse boarding or terminate the service without refund.

14. Use of Images and Compliance with Regulations
​
Photos and videos taken by clients during excursions are authorized for personal and private use only.
Clients agree not to publish or distribute content that may:

harm the image or reputation of blue invitation
-
show or suggest practices not compliant with applicable regulations
-
mislead regarding the actual conditions of the activity

Any photos or videos featuring the blue invitation team must receive prior approval.

15. Applicable Law and Disputes
​
These Terms and Conditions are governed by the laws applicable in French Polynesia.
Any dispute shall be submitted to the competent jurisdiction.
